Đây là thỏa thuận giữa khách hàng với Công Ty TNHH TM DV MVDB là đơn vị cung cấp dịch vụ phần mềm OpenDB sau đây gọi tắt là OpenDB, quy định các điều khoản trong việc khách hàng sử dụng các nền tảng, dịch vụ, template dashboard, và ứng dụng phần mềm liên quan đến giải pháp trực quan hóa dữ liệu và phân tích kinh doanh sau đây gọi chung là Dịch vụ của OpenDB. Bằng cách ký kết hợp đồng thương mại trực tiếp với OpenDB hoặc gián tiếp với đối tác bán hàng trung gian của OpenDB hoặc nhấp chuột vào nút Xác nhận hoặc các hình thức tương tự khi đăng ký sử dụng dịch vụ trực tuyến, khách hàng đồng ý rằng các điều khoản này sẽ được áp dụng trong toàn bộ quá trình sử dụng dịch vụ của khách hàng.
Điều 1: Quyền Sở hữu Trí tuệ và Giới hạn Sử dụng
1.1. A. Copyings, clones, modifications, resurgences, distributions, public displays, public performances, re-publisheds, downloads, archives, transmissions, or creations from any part of the OpenDB production without prior permission in our text.
b. The name OpenDB, which uses the brand, OpenDB logo for any purpose that causes confusion or unhealthy competition.
c. Trades for OpenDB products in all forms, including but not limited to re-selling, leased, loaned, re-enforced sublicense the tectonic dashboard or any part of service for the third party without a written agreement with us.
d. Delete, edit, modify the structure, source code, algorithm, or any technical component of the OpenDB production, including the Octopus dashboard provided.
1.4. Results of the violation: Any behavior that violates the regulations at Article 1.3 will be considered a serious violation of this provision. We have unilateral rights to end access and use your service immediately without notice. At the same time, we are completely exempt from responsibility for technical support, updates, or any other obligations related to the OpenDB product to the Crimes. The violations are at risk of facing legal actions, including the lawsuit of the people to demand damage compensation and other treatment measures according to the rule of law.
Article 2: Data and Resource Security
2.2. User Info & Information of OpenDB:
A. OpenDB is committed to protecting the personal information and business data that users provide or integrate into OpenDB's OpenDB Data Service Users According to Trade Policy. OpenDB won't reveal the user data to any third party, unless there's the user's consent or the law's demand.
b. Users are committed to secrecy and do not reveal to any third party the OpenDB's security information which Users access during service use. OpenDB's security information includes but is not limited to software products, tether dashboard, source code, design, algorithm, user interface, technical material, product planning, business secrets, and other intellectual properties owned by OpenDB.
2.2. Defending Copyright Software and Products of OpenDB:
Users committed non-implications, clones, modifications, distributions, sales, leases, removable, referse enngineer, reverse translation decompile, dissemble, or performs any other commercialization behavior for software, territted dashboard and other intellectual properties owned by OpenDB including OpenDB franchises provided through service, unless allowed by OpenDB explicitly by the text. All intellectual property rights to service and related documents belong to the NHHTH TM DV MVDDB.
2.3. Operations:
A. Any user behavior that violates security commitments or copyrighted software at this will be considered to be a serious violation of the Rule of Use.
b. In the case of the Transmission User, OpenDB has the unilateral right to suspend or end access and use the User's Services immediately without notice and without any compensation responsibility.
c. OpenDB is completely exempt from the responsibility of technical support, updates or any other service related to the Transmission User.
d. The user who violates will be responsible for the compensation of all the actual damage that would result to OpenDB Company THH DV MVDDB due to that offence. In particular, in the case that the User violates duties at the 2.2 of this has to do with unauthorized use, copying, commercializing the product of OpenDB, OpenDB has the right to claim a specific damage compensation, and at the same time apply other legal measures according to the law to protect his rights.
Article 3: Inevitability
In the event of inevitability to both parties there is no obligation to carry out his responsibility in this agreement. The two parties unanimously consider the following cases as impossible:
3.1. Disaster, enemy causes a way to turn or destroy or block or stop connecting to OpenDB's data centre.
3.2. The blackout of power on a wide scale; the blackout of the telecommunications cable which causes obstructions or ceases communications, the Internet to OpenDB's data centre.
3.3. hacker hackers, virus virus virus attacks OpenDB's data centre shuts down, jams or destroys services and data.
3.4. Other inevitability incidents follow the rule of law.
Article 4: The responsibility to advise and assist clients
4.1. OpenDB is responsible for providing consulting services, supporting customers throughout the use through:

+ Support Time: Workdays of the Week on the Co's Work schedule
4.2. In the case of the customer's need for additional consulting services outside the range of the agreement such as direct support, training services using services will be unanimously agreed on the cost and method of implementation in addition text.
Article 5: Edit, Additional Deal
5.1. OpenDB has the right to edit, supplements terms in the service deal and is published on https://www.bn.vn, on service systems and ownership pages.
5.2. The situation where the customer does not agree with the modification terms, which supplements, the customer may inform the OpenDB to complete the suspension procedure.
